Prior notice is the advance message FDA must receive and confirm before imported food reaches the United States. It is required for most food shipments, from full containers to trade-show samples and parcels posted to US customers. Many refusals have nothing to do with unsafe food: the notice was late, inaccurate, filed under the wrong data set, or never updated.
This 2026 guide covers the mistakes we see most often from UK and other foreign exporters, with the rule behind each one. It builds on our earlier article on prior notice timing, entry types and corrections and focuses on what the 2025 final rule changed. It is practical guidance, not legal advice.
- 2–8 hrs
- Minimum Lead Time by Mode
- 10 days
- To Resubmit After Refusal
- 1 Oct 2026
- Mail Tracking Required
Mistake 1: Is Your Prior Notice Confirmed Early Enough?
The minimum lead time depends on how the food arrives, and the clock only starts when FDA confirms the submission for review and issues a PN Confirmation Number, not when you press submit (21 CFR 1.279).
- Road: at least 2 hours before arrival at the US port
- Rail: at least 4 hours before arrival
- Air: at least 4 hours before arrival
- Water: at least 8 hours before arrival
If the food arrives before the full period has passed, it can be refused as untimely unless FDA has already reviewed the notice and told CBP its response (§ 1.283(a)(1)(iii)). Build in a buffer rather than filing to the minute.
Mistake 2: Filing Too Far Ahead
Early is good, but not unlimited. Through FDA's Prior Notice System Interface (PNSI), you may not submit more than 15 calendar days before the anticipated arrival date. Through the customs broker route (ABI/ACE/ITDS), the limit is 30 calendar days (§ 1.279(b)).
Mistake 3: A Missing or Out-of-Date Manufacturer Registration Number
For food that is no longer in its natural state, the prior notice must name the manufacturer and give either its FDA registration number, city and country, or its full address plus the reason the registration number is not provided (21 CFR 1.281(a)(6)).
2026 is a renewal year. A facility registration that is not renewed between 1 October and 31 December 2026 will expire, and food from a foreign facility that should be registered but is not can be held under section 801(l). To resolve that hold, a valid registration number must reach FDA within 30 calendar days of the hold notice (§ 1.285(i)(1)). Check the number on every prior notice template against your current registration, and see our FDA food facility biennial renewal 2026 guide.
Mistake 4: Vague Product Identity
FDA expects the complete FDA product code, the common or usual name, and the estimated quantity described from the largest container to the smallest package, plus lot or code numbers where FDA rules require them, such as low-acid canned foods and acidified foods (§ 1.281(a)(5)). "Snacks, 40 cartons" is not enough. A product code that does not match the food on the pallet is a classic route to an inaccurate prior notice refusal (§ 1.283(a)(1)(ii)).
Mistake 5: Leaving Out Previous Refusals
The prior notice must list any country that has refused entry to the article (§ 1.281(a)(18)). If a consignment turned away elsewhere is redirected to the US, that history belongs on the notice.
Mistake 6: Not Resubmitting When Details Change
Once FDA has confirmed a prior notice, most changes require a new prior notice, not a phone call (21 CFR 1.282). For standard shipments, the only changes you can make without resubmitting are the estimated quantity, the anticipated arrival information and the planned shipment information. Change the manufacturer, product, importer or consignee and you must resubmit, then cancel the old notice through PNSI or ask CBP to cancel the entry if it went through ACE.
For international mail, the only exception is the anticipated date of mailing. Any other change, including a new tracking number, means resubmitting.
Mistake 7: Treating a Posted Parcel Like a Courier Shipment
Food sent by international mail has its own rules, and they changed on 1 October 2026:
- Prior notice must be submitted before the parcel is sent (§ 1.279(c)).
- The notice must include the anticipated date of mailing and, from 1 October 2026, the name of the mail service and the mail tracking number (§ 1.281(b)(10)), along with the US recipient's name and address.
- The PN Confirmation Number must appear on the customs declaration, such as the CN22 or CN23 (§ 1.279(e)).
- A parcel without adequate prior notice, or without the confirmation number, is held by CBP for 72 hours. If FDA refuses it, it can be returned marked "No Prior Notice—FDA Refused", or destroyed if there is no return address (§ 1.283(e)).
Express couriers are different. A parcel moving by express consignment operator is not international mail, so it follows the general data set in § 1.281(a). The courier tracking number may be given in place of the arrival details and the air waybill number (§ 1.281(a)(11)(iv) and (a)(17)). Confirm which service a sample is actually going by before anyone files.

Mistake 8: Missing the New 10-Day Clock After a Refusal
The 2025 final rule, in force since 27 October 2025, put fixed deadlines on fixing a refusal (21 CFR 1.283(c)):
- No prior notice: if the food is not exported, a prior notice must be submitted within 10 calendar days of the refusal notice.
- Inaccurate prior notice: cancel the old notice and resubmit within 10 calendar days of the refusal notice.
- Disputing the refusal: a written request for FDA review must go in within 5 calendar days of the refusal, and only one request is allowed per refused article (§ 1.283(d)).
- Exporting instead: refused food can be exported under CBP supervision, and the prior notice should then be cancelled within 5 business days (§ 1.283(a)(5)).
While refused, the food is general order merchandise held under custodial bond, and neither FDA nor CBP pays the storage or transport costs (§ 1.283(a)(2) and (a)(4)).
Mistake 9: Hand-Carrying Food Without the Confirmation
Commercial food carried in luggage, for a trade show or a buyer meeting for example, still needs prior notice. The traveller must carry a copy of the confirmation with the PN Confirmation Number and show it to CBP or FDA on arrival (§ 1.279(f)). Without it, the food can be refused and, if it is not held or exported before the traveller leaves the port, destroyed (§ 1.283(b)).
A Quick Pre-Filing Checklist
- Confirm the transport mode and service (post, courier, air freight, ocean, road or rail).
- Check the filing window: not more than 15 days ahead via PNSI or 30 via ACE, and confirmed at least 2–8 hours before arrival.
- Verify the manufacturer's registration number is current for the 2026 renewal cycle.
- Match the FDA product code and quantity breakdown to the commercial invoice and packing list.
- Separate manufacturer, shipper, country of production and country of shipment.
- List any prior refusals.
- For mail, add the mail service name and tracking number and put the PN Confirmation Number on the CN22/CN23.
- Diarise the 5-day review and 10-day resubmission deadlines in case of refusal.
For the step-by-step filing screens, see our guide on how to file FDA prior notice in PNSI.
